END USER LICENSE AGREEMENT (EULA)

This End User License Agreement ("Agreement") is a legal agreement between you ("User" or "you") and Tripura Breath ("Company," "we," or "us") for the Tripura Breath App ("App").

By downloading, installing, or using the App, you agree to be bound by the terms of this Agreement. If you do not agree, do not install or use the App.

1. License Grant

Tripura Breath grants you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the App on a single device owned or controlled by you, solely for your personal, non-commercial purposes, strictly in accordance with the terms of this Agreement.

2. Intellectual Property & Machine Learning Model

The App, including its object code, source code, visual interface, graphics, design, and specifically the proprietary machine learning model(s) downloaded to your device as part of the App’s functionality (the "Model"), are the intellectual property of Tripura Breath.

Ownership: You acknowledge that you are licensed, not sold, the App. Tripura Breath retains all rights, title, and interest in and to the App and the Model.

Model Usage: The Model is provided solely to enable the functionality of the Tripura Breath App on your device. No rights are granted to use the Model, its weights, its architecture, or its outputs for any purpose outside of the App.

3. Strict Prohibitions and Reverse Engineering

You expressly agree that you will not, and will not permit others to:

Reverse Engineer: Decompile, reverse engineer, disassemble, or attempt to derive the source code or the underlying structure of the Machine Learning Model.

Extraction: Extract the Model from the App binary or device storage for use in other software, research, or third-party applications.

Modification: Modify, adapt, improve, enhance, or create derivative works from the App or the Model.

Circumvention: Bypass or delete any copy protection or security features used to protect the Model and the App.

4. Health and Wellness Disclaimer

The Tripura Breath App is intended for informational and wellness purposes only.

Not Medical Advice: The App does not provide medical advice, diagnosis, or treatment.

Assumption of Risk: You acknowledge that breathing exercises involve physical activity. You should consult a healthcare professional before beginning any new breathwork regimen, especially if you have pre-existing respiratory or cardiovascular conditions.

5. Privacy

Your use of the App is also governed by our Privacy Policy. Because the Machine Learning Model runs locally on your device, certain data processing may happen on-device. Please review our Privacy Policy to understand how we collect and protect your data.

6. Limitation of Liability

To the maximum extent permitted by Canadian law, Tripura Breath shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use or inability to use the App, even if we have been advised of the possibility of such damages.

7. Termination

This Agreement is effective until terminated by you or Tripura Breath. Your rights under this license will terminate automatically without notice if you fail to comply with any terms of this Agreement (specifically the anti-reverse engineering provisions). Upon termination, you must cease all use of the App and delete all copies from your device.

8. Governing Law

This Agreement is governed by and construed in accordance with the laws of the Province of Quebec and the federal laws of Canada applicable therein. You agree to submit to the exclusive jurisdiction of the courts located in Quebec.
